MyChart is an optional online service provided by Licking Memorial Health Systems (“LMHS”), which includes Licking Memorial Hospital and Licking Memorial Health Professionals.These Terms and Conditions may change without notice. Any time you use MyChart you agree to any new or modified Terms and Conditions of Use.
MyChart access is granted to me for the purpose of furthering my medical care and may be used to:
However, it is important to understand that MyChart is not a substitute for traditional medical advice, consultation, diagnosis or treatment. I understand that MyChart does not provide access to my complete medical record as maintained by LMHS. I understand that MyChart is never to be used for urgent health care matters. The anticipated turn-around time for a response to a secure message is two business days. If I am experiencing an urgent or life threatening health condition I should call my physician, go directly to the Emergency Department, or call 911.
MyChart ID and Password
I understand that I will create a unique identification (ID) code and password to be used to access my health information via MyChart. I understand that this ID and password are unique codes that identify me in the LMHS MyChart online system. Inquiries and entries that I make via MyChart will be logged by my identity.
I understand that it is extremely important that I keep my ID and password completely confidential. If at any time I feel that the confidentiality of my password has been compromised, I will change it by going to the Password link on the LMHS MyChart website. I understand that LMHS takes no responsibility for and disclaims any and all liability or consequential damages arising from a breach of medial record confidentiality resulting from my sharing or losing my password. If LMHS discovers that I have inappropriately shared my password with another person, or that I have misused or abused my MyChart access in any way, my participation in MyChart may be discontinued by LMHS without prior notice.
Availability of MyChart
MyChart is provided for my convenience and its availability is not an entitlement or a right. I understand that MyChart may not always be available to me due to instances such as routine system maintenance, back-ups or unplanned downtime. I am not guaranteed access at any particular time, and LMHS may revoke my access to MyChart at any time for any reason or discontinue the service entirely at any time.
Content of MyChart
I and my healthcare providers control the content of, and are responsible for the information sent to MyChart. Information in MyChart may be added to my medical record and may be used or shared with individuals as described by LMHS’ Notice of Privacy Practices, and federal and state laws.
Information in MyChart may include treatment for physical and mental illness, alcohol and/or drug abuse, AIDS (Acquired Immunodeficiency Syndrome), and/or may include results of an HIV test or the fact that an HIV test was performed.
Release of Information
I authorize LMHS to release my protected health information to me and to any person to whom I grant proxy access for me via MyChart. The type of information to be disclosed to me via MyChart includes medications, immunizations, diagnoses, test results, radiology and lab results, and other information collected by LMHS pertaining to my medical care. The purpose for the disclosure is ongoing communication between LMHS and me concerning my medical care. I understand that I may terminate my use of MyChart, provided notice is received prior to the release of information to MyChart. If I share information released to MyChart, it may no longer be protected by federal privacy rules, such as HIPAA.
Proxy
If I desire, I may make my medical information available to other individuals. LMHS reserves the right to revoke proxy access at any time for any reason. If the proxy's legal relationship with the patient account holder changes, the patient or proxy must inform LMHS immediately so that access may be terminated. If I am incapacitated, my Health Care Power of Attorney may be granted proxy access to my account.
Minors
Parents or guardians of minor children may request access to the minor child’s account up and until the child’s fourteenth (14th) birthday. Such access will only be granted to individuals with parental rights or legal guardianship over the patient. Minor patients who are at least thirteen (13) years of age, may request personal access to their MyChart account. Once a minor reaches the age of fourteen (14), the minor must request access for their parents or legal guardian to be granted proxy access to their account. A minor who allows a parent or legal guardian to access the minor’s account is permitting the parent or legal guardian access to information that may be confidential under State and federal law. A minor who allows the parent or legal guardian to access the minor’s account is voluntarily disclosing such confidential information, and LMHS shall not be liable for any breach of confidential information in such circ*mstance.
Appropriate Use
I understand that my access to MyChart could be terminated if I violate these Terms and Conditions or engage in inappropriate activates. Inappropriate activities include, but are not limited to: transmission of any information or message that contains unlawful, threatening, fraudulent, libelous, defamatory, obscene or abusive information or language; reserving appointment times that are not needed or are frequently cancelled; other activities that cause disruption to LMHS health care operations in the sole discretion of LMHS; or any illegal activity which includes, but is not limited to, hacking or accessing or attempting to access unauthorized areas or information on MyChart.
Links to Other Sites
MyChart may offer links to medical websites that are not part of LMHS. These website links are provided for general information purposes only. LMHS or my health care providers make no representations whatsoever about any other web site that I may access through MyChart. When I access a non-LMHS site, that site is independent from LMHS and LMHS has no control over the content of that web site. I understand that LMHS does not endorse or accept any responsibility for the content or use of any other linked site. If I decide to access any third-party site linked to MyChart, I do so entirely at my own risk.
Communications from MyChart
I may receive e-mail messages to my e-mail account notifying me that new information has been added to my MyChart account. This means that any person with access to my e-mail will be able to see this notification. Although no private or protected medical information will be sent via e-mail, the notification that new medical information is available via MyChart may be information that I do not want others to know. By signing up for MyChart, I consent to receiving e-mail messages regarding my MyChart account and should take this into account consideration when providing others access to my e-mail. It is my obligation to verify and update my email address in MyChart to ensure I receive notice of newly released information in a timely manner.
Security of MyChart
LMHS affords the same degree of confidentiality to medical information stored on MyChart as is given to medical information stored by LMHS in any other medium. LMHS is committed to protecting the confidentiality of my medical information. LMHS has implemented firewalls, passwords, encryption, and audit trails to safeguard my information.
Termination of MyChart
I understand that my access to MyChart will continue from the date of activation until terminated by LMHS or myself. LMHS may terminate or restrict my ability to use all or part of MyChart for any reason, including misuse, abuse, inactivity or for clinical reasons as determined at the sole discretion of LMHS. If my access is terminated or restricted I will be notified by e-mail or U.S. Postal Service. At any time, I may terminate my use of MyChart by notifying LMHS.
Disclaimer
I understand and agree that the use of MyChart is entirely at my own discretion and that LMHS shall not be liable for any direct, indirect, consequential, special, exemplary, punitive or other monetary damages, fees, fines, penalties or liabilities arising out of or relating to this service. I agree to defend, indemnify and hold LMHS harmless from and against any claims, actions, judgments and settlements, including legal fees that arise from my or my proxy’s misuse of MyChart.
I understand and acknowledge that this service and any content or information provided on or by the service is provided on an "AS IS" basis. LMHS does not make any warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, nor are they responsible for any action taken by you in reliance upon the information provided through this service. The laws of the State of Ohio govern these Terms and Conditions of Use.
Site Access and Licenses
LMHS grants a limited license to each user to make personal use only of the website and the associated services in accordance with these terms and conditions of use. This license expressly excludes, without limitation, any reproduction, duplication, sale, resale, or together commercial use of the website and the associated services, making any derivative of the website or the associated services, the collection and use of the user email addresses or other user information, including, without limitation, health information or any data extraction or data mining whatsoever. Through this License, you may be able to upload third party data into LMHS MyChart or download limited medical information from LMHS MyChart to select third party sites.
Copyright and Trademark
All content included on LMHS websites, including but not limited to, text, photographs, graphics, button icons, images, artwork, names, logos, trademarks, service marks and data (the "Content"), in any form including the compilation thereof, are protected buy U.S. and international copyright law and conventions. The Content includes both Content owned or controlled by LMHS, and Content owned or controlled by third parties and licensed to LMHS. Except as permitted in these Terms and Conditions, direct or indirect reproduction of the Content, in whole or in part, by any means, is prohibited without the express written consent of LMHS
